Misuse of title
In 2013 there were 381 investigations into misuse of the title ‘architect’.
This figure has increased by over 150% since 2010, with a particular rise in the level of misuse on the internet.
In 2013 6 misuse of title cases were successfully prosecuted.
This number remains constant. Where possible ARB will attempt to resolve misuse of the title by co-operation, and only pursue a criminal prosecution when it is in the public interest to do so.
To act contrary to section 20 of the Architects Act 1997 is a criminal offence. The Act sets out the maximum fine for each breach which is currently £2500. Magistrates determine the amount of the fine (and related costs) after considering the nature of the offence and any mitigation or guilty plea put forward by the defendant.
Complaints
- In 2013, 139 formal complaints were considered by the ARB.
- The number of formal complaints has remained constant in recent years, but with more of the complaints being of a serious nature that require further investigation.
Investigations Panels
- In 2013 the Investigations Panels issued 60 decisions
- In 2012 it was 80; however this higher number was due to a change in the structure of how complaints are investigated.
Professional Conduct Committee
- In 2013 the Professional Conduct Committee held 27 hearings.
- The number of cases being referred to the PCC has steadily risen in recent years, with a 70% increase since 2010.
